4-8-6: EXCEPTIONS:
The following shall not be subject to and are exempt from the smoking regulations of this chapter:
   A.   A private residence, unless used as a childcare facility, adult daycare facility or healthcare facility.
   B.   A room used by only one person in an assisted living facility as his or her residence.
   C.   A room in an assisted living facility in which two (2) or more persons reside if every person who lives in that room smokes and each of those persons has made a written request to the person in charge of the assisted living facility to be placed in a room where smoking is allowed.
   D.   A retail tobacco store that was in existence on June 3, 2009, and in which only the smoking of cigars and pipes is allowed.
   E.   A tobacco bar that was in existence on June 3, 2009, and in which only the smoking of cigars and pipes is allowed.
   F.   Use of tobacco by an enrolled member of an Indian tribe, as those terms are defined in section 139.30(4) and (5), Wisconsin statutes, as part of a traditional spiritual or cultural ceremony. (Ord. 2010-06, 6-21-2010, eff. 7-5-2010)
