4-8-2: DEFINITIONS:
In this chapter, the following terms shall mean:
ADULT DAYCARE FACILITY: Has the meaning set forth in section 49.45(47)(a), Wisconsin statutes.
ASSISTED LIVING FACILITY: A community based residential facility, as defined in section 50.01(1g), Wisconsin statutes, a residential care apartment complex, as defined in section 50.01(1d), Wisconsin statutes, or an adult family home, as defined in section 50.01(1)(b), Wisconsin statutes. See section 101.123(1)(ab), Wisconsin statutes.
CHILDCARE FACILITY: Any state licensed or county certified childcare facility including, but not limited to, licensed family daycare or licensed group daycare centers, licensed day camps, certified school age programs and head start programs.
CIGARETTE: Has the meaning set forth in section 139.30(1), Wisconsin statutes.
CITY BUILDINGS: All city owned and operated buildings and those portions of buildings leased and operated by the city.
COMMON AREAS OF MALLS: Those areas within a mall customarily accessible to patrons.
CORRECTIONAL FACILITY: Has the meaning set forth in section 101.123(1)(ac), Wisconsin statutes.
EDUCATIONAL FACILITIES: Any building used principally for educational purposes in which a school is located or a course of instruction or training program is offered that has been approved or licensed by a state agency or board.
EMPLOYEE: Has the meaning set forth in section 101.01(3), Wisconsin statutes.
EMPLOYER: Has the meaning set forth in section 101.01(4), Wisconsin statutes.
EMPLOYMENT: Has the meaning set forth in section 101.123(1)(aj), Wisconsin statutes.
ENCLOSED AREA OR ENCLOSED PLACE: All space between a floor and a ceiling that is bounded by walls, doors, or windows, whether open or closed, covering more than fifty percent (50%) of the combined surface area of the vertical planes constituting the perimeter of the area. A wall includes any retractable divider, garage door, or other physical barrier, whether temporary or permanent. A 0.011-gauge screen with an eighteen by sixteen (18 x 16) mesh count is not a wall.
ENTRANCE: A doorway and adjacent area which gives direct access to a building from a contiguous street, plaza, sidewalk or parking lot.
HEALTHCARE FACILITY: Has the meaning set forth in section 155.01(6), Wisconsin statutes.
INPATIENT HEALTHCARE FACILITY: Has the meaning set forth in section 101.123(1)(b), Wisconsin statutes.
LODGING ESTABLISHMENTS: Any of the following:
A.   A bed and breakfast establishment, as defined in section 254.61(1), Wisconsin statutes.
B.   A hotel, as defined in section 254.61(3), Wisconsin statutes.
C.   A tourist rooming house, as defined in section 254.61(6), Wisconsin statutes.

MALL: An enclosed, indoor area containing common areas and discrete businesses and stores primarily devoted to the retail sale of goods and services.
MEDICAL SERVICES: Has the meaning set forth in section 647.01(6), Wisconsin statutes.
NONSMOKING: Smoking is prohibited.
PERSON IN CHARGE: The person, or his or her agent, who ultimately controls, governs or directs the activities aboard a public conveyance or at a location where smoking is prohibited or regulated under this section. See section 101.123(1)(d), Wisconsin statutes.
PLACE OF EMPLOYMENT: Any enclosed place that employees normally frequent during the course of employment, including an office, a work area, an elevator, an employee lounge, a restroom, a conference room, a meeting room, a classroom, a hallway, a stairway, a lobby, a common area, a vehicle, or an employee cafeteria. See section 101.123(1)(dj), Wisconsin statutes. A private residence is not a place of employment within the meaning of this chapter.
PRIVATE CLUB: A facility used by an organization that limits its membership and is organized for a recreational, fraternal, social, patriotic, political, benevolent, or athletic purpose. See section 101.123(1)(dn), Wisconsin statutes.
PRIVATE RESIDENCE: Premises owned, rented or leased for temporary or permanent habitation.
PUBLIC CONVEYANCE: A mass transit vehicle as defined in section 340.01(28m), Wisconsin statutes, a school bus as defined in section 340.01(56), Wisconsin statutes, or any other device by which persons are transported, for hire, on a highway or by rail, water, air or guidewire within the city, but does not include such a device while providing transportation in interstate commerce. PUBLIC PLACE: Any enclosed place that is open to the public, regardless of whether a fee is charged or a place to which the public has lawful access or may be invited. See section 101.123(1)(eg), Wisconsin statutes.
RESTAURANT: An establishment as defined in section 254.61(5), Wisconsin statutes. See section 101.123(1)(f), Wisconsin statutes.
RETAIL ESTABLISHMENT: Any store or shop in which retail sales is the principal business conducted. See section 101.123(1)(g), Wisconsin statutes.
RETAIL TOBACCO STORE: A retail establishment that does not have a "Class B" intoxicating liquor license or a Class "B" fermented malt beverage license and that generates seventy five percent (75%) or more of its gross annual income from the retail sale of tobacco products and accessories. See section 101.123(1)(gg), Wisconsin statutes.
ROOM: A space within a building completely enclosed with walls, partitions, floor and ceiling, except for openings for light, ventilation, ingress and egress.
SMOKING: Burning or holding, or inhaling or exhaling smoke from any of the following items containing tobacco:
A.   A lighted cigar;
B.   A lighted cigarette;
C.   A lighted pipe;
D.   Any other lighted smoking equipment.

SPORTS ARENA: Any stadium, pavilion, gymnasium, swimming pool, skating rink, bowling center or other building where spectator sporting events are held. See section 101.123(1)(hm), Wisconsin statutes.
TAVERN: An establishment, other than a restaurant, that holds a "Class B" intoxicating liquor license or Class "B" fermented malt beverages license. See section 101.123(1)(im), Wisconsin statutes.
TOBACCO BAR: A tavern that generates fifteen percent (15%) or more of its annual gross income from the sale on the tavern premises, other than from a vending machine, of cigars and tobacco for pipes. See section 101.123(1)(in), Wisconsin statutes.
TOBACCO PRODUCT: Has the meaning set forth in section 101.123(1)(io), Wisconsin statutes.
TREATMENT FACILITY: A publicly or privately operated inpatient facility that provides treatment of alcoholic, drug dependent, mentally ill, or developmentally disabled persons. See section 101.123(1)(ip), Wisconsin statutes. (Ord. 2010-06, 6-21-2010, eff. 7-5-2010)
