A. Location; Time Limit: No recyclable or nonrecyclable material, whether or not it is in a container, bag or receptacle, shall be placed for collection in the traveled portion of the public right-of-way. Such material may be placed at curbside or immediately adjacent to the traveled portion of the public right- of-way provided that no such material shall be so placed for longer than twenty four (24) hours preceding collection or twelve (12) hours after collection, or, if there is no collection, for more than forty eight (48) hours.
B. Removal For Violation; Cost: If such container, bag or receptacle or such recyclable or nonrecyclable material shall remain for a period of time not permitted by this section, the Public Health Officer or designee may cause such material to be removed and to report the expense of fifty dollars ($50.00) and the volume based disposal charge established by the City to the City Treasurer-Comptroller with a description of the lot or parcel of land adjoining which the same shall have been incurred. The amount of such expense shall be invoiced to the owner of the property from which such material was removed and, if not paid within thirty (30) days, shall be entered in the tax roll as a special tax against said property.
C. Penalty: Any person who shall violate any provision of this section, shall, upon conviction thereof, forfeit not more than one hundred dollars ($100.00) together with the cost of prosecution, for the first offense, and not more than two hundred dollars ($200.00), together with the cost of prosecution, for each subsequent offense. These penalties shall be in addition to the cost of removal of the said material as provided above. (1975 Code Ch. 10 § VIII)
