5-1-14: DISORDERLY CONDUCT RELATED TO ELECTION WORKERS:
   A.   Definitions: As used in this section, the following terms shall have the meanings indicated:
 
ELECTION OFFICIAL:
Has the same definition provided in Wis. Stat. § 5.02(4e), meaning an individual who is charged with any duties related to the conduct of an election.
TELE- COMMUNICATION DEVICE:
Any instrument, equipment, machine, or other device that facilitates telecommunication, including but not limited to, a computer, computer network, computer chip, computer circuit, scanner, telephone, cellular telephone, pager, personal communications device, radio, transponder, receiver, modem, or device that enables the use of a modem.
TELE- COMMUNICATION MESSAGE:
Any transfer of signs, signals, writing, images, sounds, data, or intelligence of any nature.
 
   B.   Prohibited Actions: Whoever does any of the following within the limits of the City of Menomonie shall be subject to a forfeiture as outlined in subsection C:
      1.   Engages in any of the following behavior directed at an individual working in their capacity as an election official or based on their position as an election official:
         a.   In a public or private place, engages in violent, abusive, indecent, profane, boisterous, unreasonably loud, or otherwise disorderly conduct under circumstances in which such conduct tends to cause or provoke a disturbance; or
         b.   With intent to harass, annoy, or offend another, sends a telecommunication message to a telecommunication device and uses any violent, abusive, indecent, or profane language or image, or any other message which tends to cause or provoke a disturbance.
   C.   Penalty: Any person who shall violate any provision of this section, shall, upon conviction thereof, forfeit not more than one hundred dollars ($100.00) together with the cost of prosecution, for the first offense, and not more than two hundred dollars ($200.00), together with the cost of prosecution, for each subsequent offense.
   D.   Severability: If any provision, paragraph, word, section, or subsection of this chapter is invalidated or deemed unconstitutional by any court of competent jurisdiction, the remaining provisions, paragraphs, words, sections, and subsections shall not be affected and shall continue in full force and effect.
