A. Applicability: This section shall apply to any businesses engaged in the sale, service, rental or storage of motor vehicles.
B. Key Control and Security:
1. Owners shall take adequate measures to secure motor vehicle keys and key fobs by securing them in a locked safe, lockbox or locked cabinet during those hours when the business is not open to the public. Keys shall not be kept in a lockbox affixed to the vehicle.
2. During business hours, owners shall employ adequate key control procedures so as to prevent the easy access to vehicle keys by unauthorized persons.
3. After-hours key drop boxes shall be constructed and secured in such a way as to prevent access to keys except by authorized personnel.
4. Vehicle keys shall not be left in any vehicles.
C. Penalty: Any person who violates any provision of this section shall, upon conviction, be subject to a forfeiture not to exceed a base forfeiture of $50.00 plus costs.
D. Owner Liability for Investigation and Recovery: In addition to any other penalties described above, the owner of any vehicle stolen due to the failure to comply with this section shall be responsible for the law enforcement costs of investigation and recovery of the vehicle.
