Before obtaining a business license, and as a condition of renewal and/or continuation of such business license, all massage businesses and establishments, as defined in Chapter 5.45 of this Code, shall comply with the requirements of that chapter. The City Council by resolution may set additional appropriate fees for such massage business licenses. Prior to obtaining a massage business license, a valid conditional use permit (CUP) must be active at the site of the proposed massage business or establishment. CUPs may contain a condition indicating that violations of any provision of this Chapter 5.01, Chapter 5.45, or any other provision of this Code, state, or federal law, will subject the CUP to revocation. A revocation of any CUP allowing for the operation of a massage business or establishment shall prohibit a new CUP from being approved for a massage business or establishment at the same location for five years.
