§ 10.05.120 VIOLATION; PENALTY.
   Every owner, driver or keeper of any animal who permits the animal to be in any building, enclosure, lane, street, square or lot within the City of Menifee without proper care or attention shall be guilty of an infraction or misdemeanor as hereinafter specified. Such individual shall be deemed guilty of a separate offense of each and every day or portion thereof during which any violation of any of the provisions of this chapter is committed, continued or permitted. Any individual convicted of a violation of this chapter shall be: (1) guilty of an infraction offense and punished by a fine set by the City Council via resolution which may be updated from time to time; (2) guilty of an infraction offense and punished by a fine set by the City Council via resolution which may be updated from time to time. The third and any additional violations shall constitute a misdemeanor offense and shall be punishable by a fine set by the City Council via resolution which may be updated from time to time, six months in jail, or both. Notwithstanding the above, a first offense may be charged and prosecuted as a misdemeanor. Payment of any penalty herein shall not relieve an individual from the responsibility for correcting the violation.
