(A) Any person violating any of the provisions of this chapter shall be guilty of an infraction, and upon conviction thereof shall be punished by fines as set by the City Council via resolution which may be updated from time to time. Each day a violation is committed or permitted to continue shall constitute a separate 1 offense.
(B) Notwithstanding the foregoing, a first and any subsequent violation of the ordinance codified in this chapter may be charged and prosecuted as a misdemeanor.
