A. Statutory Authority: This chapter is adopted pursuant to Minnesota statutes section 473.192. (Ord. 232, 5-19-1987; amd. 2003 Code)
B. Findings Of Fact: The city finds that development within certain areas of the city is impacted by aircraft noise; that said noise is beyond the regulatory authority of the city to control; that certain uses of land are inappropriate in areas of high aircraft noise; that some structures do not adequately attenuate aircraft noise resulting in negative impacts on the health, safety and welfare of the residents or inhabitants of the structures; that, through proper construction methods, the means exist to attenuate aircraft noise to interior levels which alleviate such negative impacts; and that the requirements of this chapter are necessary to promote and preserve the health, safety and welfare of the citizens of Mendota Heights. C. Applicability: The provisions of this chapter shall apply to all properties located within the 2004 MSP zoning ordinance airspace zoning limit. Properties located partially within the 2004 MSP zoning ordinance airspace zoning limit shall be considered completely inside the limit. (Ord. 494, 5-3-2016)
