A. Substances Prohibited: No person or persons shall possess, sell, distribute or administer any coca leaves, opium, isonipecaine, amidone, isomidone, ketabemidone, Cannabis indica, Cannabis sativa, marijuana, any other substance which is chemically or physically indistinguishable from them, any other drug to which the federal narcotic laws may now apply or any other drug which is hereafter included under the federal narcotic laws and found by the state commissioner of health, after reasonable notice and opportunity for hearing, to have an addiction forming or addiction sustaining liability similar to morphine or cocaine, from the effective date of determination of such finding by said state commissioner of health. B. Possession Or Use Of Paraphernalia Prohibited:
1. No person or persons, except dealers or salesmen of surgical instruments, registered pharmacies, licensed pharmacists, licensed doctors of medicine, doctors of osteopathy duly licensed to practice medicine, licensed doctors of dentistry, licensed doctors of veterinary medicine, or nurses or interns in any licensed hospital or other licensed institutions wherein sick and injured persons are cared for or treated, or bona fide hospitals wherein animals are treated, when under the direction and supervision of a licensed doctor as defined above, shall at any time have or possess any hypodermic syringe or needle or have or possess any other instrument or implement adapted for the use of cocaine or narcotic drugs by subcutaneous injections, unless such possession be authorized by the certificate of a physician issued within the period of one year prior to any time of such possession.
2. No person shall use, possess or have under his control for use any stem, bowl, lamp, yen hock or other smoking paraphernalia or accessories used for the smoking or inhalation of any of the narcotics or similar type substances described in subsection A of this section.
C. Exemptions: The provisions of this section restricting the possession of narcotic drugs specified in subsection A of this section and instruments or implements specified in subsection B of this section shall not apply to common carriers or warehousemen, or their employees, engaged in lawful distribution or storage of such drugs or materials, or any thereof, or to public officers or employees while engaged in the performance of their official duties, or to the temporary incidental possession of such drugs or implements, or any thereof, by employees or agents of persons lawfully entitled to possession thereof.
