For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BOARDINGHOUSE. A dwelling where meals, or lodging and meals, are provided for definite periods of not less than one week. A BOARDING HOUSE is to be distinguished from a hotel, motel or a convalescent home.
CERTIFICATE OF COMPLIANCE. A certificate issued by the Department of Building Inspection which certifies compliance with this section and the date of such certification.
CONVALESCENT OR NURSING HOMES. A home for the care of children, the aged or infirmed, or a place of rest for those suffering from bodily disorders, wherein three or more people are cared for. Such a home shall also conform to and qualify for a license under applicable state laws.
HOTEL. A building occupied in a more or less temporary abiding place for individuals who are lodged with or without meals in rooms, occupied singly for hire, in which provision is not made for cooking on any individual plan and in which there are more than ten sleeping rooms.
HOUSING AND BUILDING CODES. The standards of construction and maintenance for all residential property and specific residential rental property as adopted by the city.
INSPECTION GUIDELINES. Those guidelines as adopted by the city to be used by the Building Official in conducting inspections, setting forth the minimum requirements for dwellings inspected under this chapter.
LEASE. Any written or oral agreement that sets forth conditions concerning the use and occupancy of residential rental structures or residential units by a person paying rent or for whom rent is paid.
MANAGER. A person, partnership, firm or corporation that actively operates or manages a rental property for the owner.
MOTEL. Series of attached, semi-detached, or detached rental units which may or may not be independently accessible from the outside parking area, containing bedroom, bathroom, and closet space
and designed for or occupied primarily for transients. No kitchen or cooking facilities are to be provided without the approval of the City Planning Commission, with the exception of units for use of the manager and/or caretaker.
OCCUPANTS. Tenants, lessees and/or persons residing in a residential rental structure or residential rental unit.
OWNER. Any person, agent, firm, or corporation having a legal or equitable interest in a residential rental structure or residential rental unit.
PERSON. An individual, partnership, firm or corporation.
RENT. To let, to lease, to barter or to pay a consideration to another for the privilege of residing in a residential rental unit for any period of time.
RENTAL HOUSING OFFICIAL. The inspector, enforcing officer, or authorized representative appointed by resolution of the City Council.
RESIDENTIAL RENTAL STRUCTURE. Any building that contains one or more rental units.
RESIDENTIAL RENTAL UNIT. Any apartment, room, dwelling house or portion thereof or any condominium for which a person or a group of persons pays rent directly or indirectly to the owner thereof for the purpose of a person or persons to reside therein. This definition includes one-family and two-family dwellings, multiple family dwellings, apartment units, boarding houses, rooming houses, flats and condominium units. This definition does not include hotels and motels licensed and inspected by the state.
ROOMING HOUSE/SEASONAL OR YEAR-ROUND MIGRANT LABOR CAMPS. A dwelling house where lodging, rooms or housekeeping or living accommodations are provided for compensation to four or more individuals by prearrangement for definite periods of not less than one week. A ROOMING HOUSE is to be distinguished from a hotel, motel, or a convalescent or nursing home.
TO SECURE. To board up or otherwise make the premises inaccessible by anyone other than the owner or the City Building Official.
