(a) For the purposes of this article, the following terms shall have the meaning set forth in this section.
(1) BENEFIT AREA. The area(s) benefitted by the stormwater management system program, the boundaries of which are described in § 27-4.
(2) COMMISSION. The Town Commission.
(3) DIRECTOR. The Town Manager, or such other person as is designated by the Town Manager.
(4) DIVISION. The stormwater utility program or its successor in function.
(5) EQUIVALENT RESIDENTIAL UNIT (ERU). To serve as reference from which an equitable distribution of the cost of services and facilities can be made among all properties within
the town through a stormwater management service charge rate methodology. The equivalent residential unit within the town for the purpose of service charge ratemaking has been determined through engineering analysis to be a gross area of 2,500 square feet of effective impervious area.
(6) IMPERVIOUS AREAS. Surfaces which have been compacted or covered with a layer of material which is highly resistant to infiltration by water, such as roofed and paved areas, including, but not limited to, areas covered by roofs, roof extensions, slabs, patios, porches, driveways, sidewalks, parking areas and athletic areas. It shall also include semi-impervious areas, such as compacted clay.
(7) LOT. A parcel of land shown on a recorded plat or on the Brevard County Property Appraiser's maps, or any piece of land described by deed and recorded in the Public Records of Brevard County, Florida.
(8) PERSON. Any and all persons, natural or artificial, and includes any individual, firm, corporation, governmental agency, business trust, estate, trust, partnership, association, two or more persons having a joint or common interest, or any other legal entity.
(9) PROPERTY OWNER. The person in whom is vested the fee ownership, dominion, or title of real property. This term may also include a tenant, if chargeable under tenant's lease for the maintenance of the subject real property, and any agent of the owner or tenant, including a developer.
(10) STORMWATER MANAGEMENT PROGRAM. The town program by which the objectives set forth in § 27-1(b) shall be achieved and pursuant to which a stormwater utility shall be operated to achieve those objectives.
(b) When consistent with the context, words used in the present tense shall include the future, and words in the future tense shall include the present tense. Words in the plural shall include the singular, and words in the singular shall include the plural. Words in the male gender shall include the female gender, and the word 'shall' is always mandatory and not merely directive.
