8-2-8: PRIVATE SEWAGE DISPOSAL SYSTEMS:
   A.   Private Systems Permitted: Where a public sewer is not available under the provisions of subsection 8-2-7E of this chapter, the building sewer shall be connected to a private sewage disposal system complying with the provisions of this chapter.
   B.   Permit Requirements:
      1.   Permit Required: Before commencement of construction of a private sewage disposal system, the owner shall first obtain a written permit signed by the Superintendent.
      2.   Application For Permit: The application for such permit shall be made on a form furnished by the City which the applicant shall supplement by any plans, specifications and other information as are deemed necessary by the Superintendent.
      3.   Fees: A permit and inspection fee shall be paid to the City at the time application is filed in accordance with the provisions of section 8-2-6 of this chapter.
      4.   Conditions Of Permit Issuance: A permit for a private sewage disposal system shall not become effective until the installation is completed to the satisfaction of the Superintendent. He shall be allowed to inspect the work at any stage of construction, and in any event, the applicant for the permit shall notify the Superintendent when the work is ready for final inspection and before any underground portions are covered. The inspection shall be made within forty eight (48) hours, Sundays and holidays excluded, of the receipt of the notice by the Superintendent. (Ord. 63, 5-6-1975)
   C.   Construction Specifications:
      1.   The type, capacities, locations and layout of a private sewage disposal system shall comply with all recommendations of the State Department of Health and Welfare. (Ord. 63, 5-6-1975; amd. 2008 Code)
      2.   No permit shall be issued for any private sewage disposal system employing subsurface soil absorption facilities where the area of the lot is less than ten thousand (10,000) square feet.
      3.   No septic tank or cesspool shall be permitted to discharge into any public sewer or any stream or watercourse. (Ord. 63, 5-6-1975)
   D.   Availability Of Public Sewer; Connection Required: At such time as a public sewer becomes available to a property served by a private sewage disposal system as provided in subsection 8-2-7E of this chapter unless otherwise exempted by City Council, a direct connection shall be made to the public sewer in compliance with the ordinances, rules and regulations of the City, and any septic tanks, cesspools, and similar private sewage disposal facilities shall be abandoned, cleaned of sludge and filled with clean, bank run gravel or dirt.    E.    Responsibility For Private System: The owner shall operate and maintain the private sewage disposal facilities in a sanitary manner at all times, at no expense to the City.
   F.   Additional Requirements: No statement contained in this section shall be construed to interfere with any additional requirements that may be imposed by any law, ordinance, rule or regulation. (Ord. 63, 5-6-1975)
