§ 15.2.06 STATEMENT OF WAIVER.
   (A)   If the Commission fails to act upon an application for a certificate of appropriateness within 30 days of filing of the application, unless such time limit is extended by mutual agreement in writing, such failure to act shall constitute a waiver by the Commission of any requirements for a certificate of appropriateness.
   (B)   If the Commission fails to mail to the applicant notice of the granting or denial of a certificate of appropriateness within 3 business days of that decision, such failure shall constitute a waiver by the Commission of any requirement for a certificate of appropriateness.
   (C)   In the event of any such waiver by the Commission, it shall issue a statement of waiver to the applicant within 30 days after such waiver is brought to the attention of the Commission.
   (D)   If the construction, alteration, or demolition has not commenced within 1 year after the date of issuance of the statement of waiver, the statement of waiver shall expire.
