§ 13.1.03 POSSESSION AND PURCHASE OF TOBACCO PRODUCTS AND NICOTINE PRODUCTS BY STUDENTS.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      CIGARETTE. The meaning given in Wisconsin Statutes § 139.30(1).
      LAW ENFORCEMENT OFFICER. The meaning given in Wisconsin Statutes § 30.50(4s).
      NICOTINE PRODUCTS. The meaning given in Wisconsin Statutes § 134.66(1)(f).
      TOBACCO PRODUCTS. The meaning given in Wisconsin Statutes § 139.75(12).
   (B)   Except as provided in division (C) of this section, no students may do any of the following:
      (1)   Buy or attempt to buy any cigarette, tobacco product, or nicotine product.
      (2)   Falsely represent his or her age for the purpose of receiving any cigarette, tobacco product, or nicotine product.
      (3)   Possess any cigarette, tobacco product, or nicotine product.
   (C)   A person under the age of 18 years may purchase or possess cigarettes, tobacco products, or nicotine products for the sole purpose of resale in the course of employment during his or her working hours, if employed by a retailer licensed under Wisconsin Statutes § 134.65(1).
   (D)   A law enforcement officer shall seize any cigarette, tobacco product, or nicotine product involved in any violation of division (B) of this section in his or her presence.
