(A) This chapter shall not create any liability for damages that result from reliance on this chapter on the part of the County Fiscal Court, McLean County DES, duly authorized responding personnel and dispatched private environmental response entity, or administrative decisions lawfully made hereunder.
(B) Each entity mentioned in division (A) above shall make a separate determination, to their own satisfaction, the level of financial commitment and insurability or bond, in addition to that which may be required under other sections of this chapter, so as to initiate the most expeditious response to an occurrence and the subsequent mitigation of any unauthorized release causing risk to the general public and environmental.
