The owner of any house, building or property used for human occupancy, employment, recreation or other purposes and abutting on any street, alley or rights-of-way in which there is or may be located a wastewater sewer connected to any treatment facility, is required, at the owner expense, to install suitable toilet facilities therein and connect such facilities directly to the proper sewer in accordance with the laws and regulations applicable to the sewer connections, within 90 days after date of official notice to do so; provided, the proper wastewater sewer is within 100 feet of the property lines; provided further that, the owner of any such house, building or property upon which is situated a septic tank that has been constructed within three years prior to the adoption of this chapter and which is functioning properly and from which wastewater is not leaking and which is not creating any health hazard, may delay for a period of 12 months connecting to the sewer facility.
