(A) County responsibility defined. The county shall provide for the collection of residential, commercial and agricultural solid waste by means of a convenience center which is the transfer site at the McLean County Road Department.
(B) Collection points. Points of collection of solid waste shall be from the roadside or curbside within public rights of way or other locations near buildings, parking lots, etc., on private property. In general, solid waste generated by residential or agricultural operations shall be placed along the roadside or curbside fronting the subject property no more than 12 hours before collection. All reusable storage containers shall be removed from the roadside or curbside by the owner occupant within 12 hours after collection. Residential waste, commercial and agricultural waste that require bulk storage containers shall be located on private property in areas accessible to collection vehicles.
(C) Bulky rubbish. The code enforcement officer shall establish the procedures for disposal of bulky rubbish and yard waste generated by residential dwelling units and multi-family residential dwelling units.
(D) Ownership of solid waste. All solid waste placed in the convenience center shall become the property of the county or its duly authorized agent and no person shall be allowed to separate, carry off or dispose of same without written permission of the code enforcement officer.
(E) Collector’s responsibility defined. Solid waste collectors operating within the county shall be responsible for the collection of solid waste from collection points to a transportation vehicle. Spillage or blowing solid waste caused as a result of the duties of the solid waste collector shall be collected and placed in the transportation vehicle by the collector.
(F) Collection frequency. Any person providing solid waste collection and transportation services and operating under a permit issued under the authority of this chapter shall provide said services at a minimum frequency of once per week.
(G) Acceptable collection practices. Collection practices which are deemed acceptable by the county are as follows:
(1) Door-to-door residential collection. Collection service may be provided by the private sector with proper permit.
(2) Direct access to a convenience center or transfer facility within the solid waste management planning area. Citizens of the county may transport their residential, commercial or agricultural waste directly to permitted convenience centers or the transfer site with the boundaries of the planning area which meet the environmental performance standards of 401 KAR 47:030.
(H) Prohibitions. The following wastes may not be deposited in the convenience center or transfer site.
(1) Hazardous waste;
(2) Liquid waste;
(3) Dead animals;
(4) Any burning or smoldering materials or any other materials that will create a fire hazard.
