Any person found to be in violation of any provision of this chapter shall be guilty of a separate offense for each day or portion thereof during which such violation is committed, continued or permitted, and each offense may be punishable by a fine of not more than two hundred dollars ($200.00), or to imprisonment in the county jail for a period of not more than six months, or both, at the discretion of the court.
A. Any person, firm or corporation who alters, repairs, relocates or demolishes by neglect any landmark or any structure within a preservation district without complying with the provisions of this chapter shall be required to restore the building or structure and its site to its appearance prior to the violation. Any action to enforce this section shall be brought by the McHenry County State’s Attorney, a designee or by designated representative of the McHenry County Building and Zoning Department. This civil remedy shall be in addition to and not in lieu of any criminal prosecution and penalty contained in this section.
B. In the case of an unauthorized demolition of a landmark or any property within a designated preservation district, the McHenry County Building and Zoning Department will refuse to issue a building permit for the subject property for a period of five years after the date of the demolition.
