A. Upon receipt of an application properly filed with the Commissioner, and upon payment of the nonrefundable fee, the Commission shall immediately stamp the application as received and shall immediately thereafter send photocopies of the application to the McHenry County Sheriff’s Department, and any other county department or agency responsible for enforcement of health, fire, building codes, and ordinances which apply to the property in question. The Commission shall also notify the applicant(s) which departments and agencies will be involved in the review process.
B. Each department or agency shall promptly conduct an investigation of the application, applicant(s) and the proposed adult business in accordance with its responsibilities under law and as set forth in this ordinance. Said investigation shall be completed within thirty (30) business days of receipt of the application by the Commission. At the conclusion of its investigation, each department or agency shall indicate on the photocopy of the application its approval or disapproval of the application, date it, sign it, and in the event it disapproves, the reasons therefor.
C. A department or agency shall disapprove an application if it finds that the proposed adult business is in violation of any provision of any statue, code, ordinance, regulation or other law in effect in McHenry County. After its indication of approval or disapproval, each department or agency shall immediately return the photocopy of the application to the Commission.
