Upon receiving a Conditional Use permit to operate an adult business, all applicants desiring to secure a license, under the provisions of this ordinance, shall submit to the Commissioner written, signed and verified application or renewal application, on the form provided by the Commission. All applications shall become a permanent record of the Commission. Under oath each application shall state the following:
A. Name, social security number and permanent address of the applicant(s);
B. Name, business address and FEIN number if applicable, of the applicants(s). If the applicant(s) is a corporation, the name shall be exactly as set forth in its articles of incorporation and the applicant(s) shall show the name and residence address of each of the officers, directors and each stockholder owning no less than five percent (5%) of the stock of the corporation. If the applicant(s) is a partnership, the application shall show the name and residence address of each of the members, including limited partners, if the applicant(s) is a land trust, then the application shall show the land trust’s complete name, the legal name, all aliases, and the business address of the trustee of the land trust along with the legal name, all aliases, and the ages, business addresses, and social security numbers of each beneficiary of the land trust and the specific interest of each such beneficiary in the land trust and the interest, if any, that the land trust holds in the licensed premises;
C. The location and address of the adult business;
D. Hours of operation;
E. The name or names of the person or persons having management or supervision of the applicant(s)’ business;
F. For a renewal application, the applicant(s) in addition shall indicate any changes since the filing of the initial application;
G. If applicable, date of filing of an “assumed name” of its business with the McHenry County Clerk;
H. 1. If a person who wishes to operate an adult business is an individual, he/she must sign the application for a license as applicant. If a person who wishes to operate an adult business is other than an individual, each individual who has a five percent (5%) or greater interest in the business must sign the application for a license as applicant. If a corporation is listed as owner of an adult business or is the entity which wishes to operate such a business, each individual having a five percent (5%) or greater interest in the corporation must sign the application for a license as applicant.
2. Application to renew an adult business license shall be submitted to the Commissioner no later then the first (1st) day of March. Failure to provide the information required by this ordinance shall constitute an incomplete application and shall not be processed.
