§ 2.56.040 COURT SERVICES FEE (COURT SECURITY FEE).
   A.   The County Board does hereby set a court security fee in the following differential amounts:
      1.   Civil cases:
         a.   Law under $15,000: $20;
         b.   Small claims cases: $20; and
         c.   All other cases: $20.
      2.   Criminal and quasi-criminal cases:
         a.   Felony, misdemeanor and DUI cases: $25; and
         b.   All other cases, including local and county ordinance and conservation: $25.
   B.   1.   The above fees shall be assessed in civil cases against each party at the time of filing the first pleading, paper or other appearance; provided, no additional fee shall be required if more than one party is presented in a single pleading, paper or other appearance.
      2.   In criminal, local ordinance, county ordinance, traffic and conservation cases, the above fees shall be over and above and fine amount and be assessed against the defendant upon a plea of guilty, stipulation of facts or findings of guilty, resulting in a judgment of conviction, or order of supervision, or sentence of probation without entry of judgment pursuant to § 10 of the Cannabis Control Act and §
   C.   This court security fee shall not be imposed or collected in traffic, conservation or ordinance cases in which fines are paid without a court appearance whether in person or by mail.
   D.   The McHenry County Treasurer shall deposit fees collected from said fee, in the separate revenue line item, known as “Court Services Fee” in the McHenry County Corporate Fund, as a fee collected from the Sheriff’s Department, collected pursuant to this section and all proceeds from this fee and must be solely used to defray court security expenses incurred and deemed necessary by the sheriff to provide court services pursuant to 44 ILCS 5/3-6023 and as authorized and stipulated under state law.
