§ 2.48.190 NON-COMPETITIVE PROCUREMENT.
   A.   General. A Contract may be awarded without competition when a Department Head determines, and Purchasing concurs in writing, and it is not required by law, after conducting a good faith review of available sources, that the Contract by its very nature is not suitable to competitive Bids or proposals. Examples of Contracts which may not be suitable for competitive Bids or proposals are Contracts where:
      1.   there is only one source for the required Goods and Supplies, Service, or Construction;
      2.   a sole supplier’s item is needed for trial use or testing;
      3.   products are bought for over-the-counter resale;
      4.   purchases of Used Equipment; and
      5.   purchases at auctions.
   B.   Negotiation. The Director of Purchasing and responsible Department Head can conduct negotiations, as appropriate, as to price, delivery, and terms.
