521.11 WATER EMERGENCIES.
   (a)    No person shall fail to abide by any mandatory water restrictions as ordered by Council on March 4, 1992, concerning the usage of water ordered by the Governor of the State of Ohio, the Ohio Environmental Protection Agency, the Mahoning Valley Sanitary District or the Village Administrator of the Village, in the event of declaration by any of the above persons and/or entities that a water emergency exists and/or that restrictions upon the normal use of water are necessary.
   (b)    No person shall fail to abide by any of the following mandatory water restrictions:
      (1)    No fire hydrant flushing or flow testing.
      (2)    No sewer flushing using potable water.
      (3)    No street sweeping using potable water.
      (4)    No residential or governmental fleet washing of vehicles.
      (5)    No washing down of residential garage floor areas or power washing of parking lots.
      (6)    No bulk water hauler sales.
      (7)   No fire hydrant permits for construction use.
      (8)    Reduce standard three day inside leak notice to twenty-four hours.
      (9)    No filling of any swimming pools, including municipal pools.
      (10)    Require all restaurants to provide drinking water only upon request.
      (11)    No sprinkling of lawns, flower gardens, shrubs, trees or plants, except for fruit and vegetable plants.
   (c)    If any customer, consumer and/or user of the McDonald water supply system is discovered to be in violation of any mandatory restrictions as set forth in this section, the Village Administrator is hereby authorized to penalize the violator as follows:
      (1)    For violation of the restrictions on residential, governmental or commercial fleet washing of vehicles:
         A.    First violation: Fifty dollars ($50.00) per vehicle washed.
         B.    Second violation: Five hundred dollars ($500.00) fine plus automatic shut off of water service until fine is paid in full.
      (2)    For violation of the restrictions for washing down garage floor areas or power washing of parking lots:
         A.    First violation: Fifty dollars ($50.00) fine plus automatic water shut off until fine is paid in full.
         B.    Second violation: Five hundred dollar ($500.00) fine plus automatic shut off until fine is paid in full.
      (3)    For violation of the restrictions for use of fire hydrants for construction:
         A.    Each violation five hundred dollars ($500.00) per day of use.
      (4)    For violation of restrictions on filling swimming pools:
         A.    First violation: Five hundred dollar ($500.00) fine plus a surcharge of the regular rate for water provided multiplied by three (the cost of obtaining water elsewhere) plus automatic shut off until fine and bill are paid in full.
         B.    Second violation: Five hundred dollar ($500.00) fine plus a surcharge of the regular rate for water provided multiplied by three plus mandatory seven day shut off of water. '
      (5)    For violations of ban on sprinkling of lawns, flower gardens, shrubs, trees and plants:
         A.    First violation: Fifty dollar ($50.00) fine.
         B.    Second violation: Five hundred dollar ($500.00) fine plus automatic shut off.
         C.    Third violation: Five hundred dollars ($500.00) fine plus automatic seven day shut off.
   (d)    Restrictions apply only to water purchased from the Village Water Department. Filling of swimming pools, commercial fleet washing and other restricted uses can still be accomplished by using bulk water purchased from other than the Meander Reservoir supply.
