351.091 PROHIBITION OR RESTRICTION AGAINST PARKING OR STORAGE OF COMMERCIAL VEHICLES AND HEAVY EQUIPMENT IN RESIDENTIAL DISTRICTS.
   (a)   None of the following described commercial vehicles shall be parked or stored in a residential district (RA or RB Districts):
      (1)   A truck or commercial vehicle with a capacity for gross vehicle weight (g.v.w.) of more than 10,500 pounds; or
      (2)   A commercial tractor and/or trailer used for freight purposes; or
      (3)   A bus or motor coach used for commercial purposes.
   (b)   In a residential district (RA or RB Districts) the parking or storage of heavy equipment used for business, freight or commercial purposes is prohibited.
   (c)   For the purposes utilized herein, gross vehicle weight (g.v.w.) shall mean the actual weight of the entire vehicle, including, but not limited to, all equipment, fuel, payload, driver and passengers. For purposes utilized herein payload shall mean the actual weight or commodity being hauled or, alternatively, the capacity and weight specified by the manufacturer as the maximum loaded weight specified for a single vehicle.

   (d)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
