The site location of any landfill and construction and demolition debris storage management site shall be restricted and limited as follows:
(a) Shall be no closer than one thousand (1,000) feet to a stream, lake, river, waterway, pond, or potable water source of any type or manner whatsoever;
(b) Shall be no closer than one thousand (1,000) feet to any lot, parcel or piece of real property zoned as Residential (RA Districts), Residential (RB Districts), Business and Commercial (CA and CB Districts), nor closer than one thousand ($1,000) feet to any “environmentally natural area,” to include, but not limited to, undisturbed, established, or re-established areas intended for scientific, recreational or educational purposes and any “wetland” in accordance with the accepted definitions set forth by the Ohio Department of Natural Resources and United States Army Corps of Engineers;
(c) Shall not permit contamination of any aquifer, stream, lake, river, waterway, pond, or potable water source as determined by independent hydrologic survey;
(d) Shall not be within the natural terrain boundaries of a one hundred (100) year flood plain as determined by the Trumbull County Engineer;
(e) Shall be no closer than one thousand (1,000) feet to any school, park, playground, recreational area, or religious building; or
(f) Shall not create a nuisance, hazard, or pollution effects, (i.e., visual, olfactory, audio) or cause a nuisance from dust or particles of dust, including that which occurs during unloading activities and through transport of waste. Definition of olfactory nuisance determined by levels of scientific accepted as that which are above ambient levels, or irritating to senses. Audio emissions at property line not to exceed 45 decibels (ambient background levels) during construction or operation as measured by trained City personnel, i.e., police or fire personnel. The use of OSHA approved alternatives or sound barriers shall be used to maintain ambient background levels.
(g) Shall not violate any law or ordinance, including, but not limited to, rules and regulations of the OEPA, USEPA, TCSWD, along with the Village’s ordinances, Ohio law, Federal law, and local laws.
