§ 34.20  POLICE EQUIPMENT FUND.
   (A)   There is hereby created a special non-reverting fund to be known as the Police Equipment Donation Fund. A special account is to be designated as a Police Equipment Donation Fund.
   (B)   The Clerk-Treasurer of the town shall create a specifically designated fund entitled the “Police Equipment Donation Fund”, into which all funds donated for the purpose of purchasing police equipment shall be deposited.
   (C)   The funds deposited into the account may be used to purchase, rent or lease equipment for any and all law enforcement purposes and/or activities.
   (D)   The generation of these funds may be created by whatever lawful means that the Town Council and the Town Marshal deem reasonable and necessary.
   (E)   The disbursements of the monies shall be made only upon the agreement of the Town Marshal, the Deputy Town Marshal, including a Reserve Deputy Marshal, and the Police Commissioner or, in his or her absence, the President or Vice President of the Town Council; however, no expenditures from this fund may be made which would increase the town’s liability exposure or potentially impact negatively the budget for the fiscal year in which the purchase was made.
