(A) For the service provided by the town consisting of the collection of trash, garbage and refuse, and off-site recycling services (i.e. the trash collection service), there shall be charged to and collected from the owners of each and every lot, parcel of real estate or building that receives said trash collection a service fee of $10.18 per month (the “Trash Collection Fee”).
(B) The trash collection fee shall be prepared, billed and collected by the town in the manner provided by the Act, this section and as follows:
(1) The trash collection fee shall be prepared and billed monthly. For users that do not occupy a location served by the trash utility on the first day of the month, or the last day of the month, their charges shall be prorated on a per diem rate calculated on the basis of 30 days per month times the monthly rate and charge for users of the same type and category multiplied by the number of days in the month the user occupies the premises.
(2) The trash collection fee may be billed to the tenant or tenants occupying the property served only upon the written request of the property owner and the acknowledgment of the property owner that the property owner remains liable for any and all outstanding and unpaid charges to the address and service may be terminated if the property owner does not pay the statement, even if the charges were under the tenant’s name.
(3) The owners of properties served, which are occupied by a tenant or tenants, shall have the right to examine the collection records of the town for the purpose of determining whether bills have been paid by such tenant or tenants, provided that such examination shall be made at the office at which such records are kept and during the hours that such office is open for business.
(4) All trash collection fees not paid by the 15th day of the month following receipt (the “due date”) are hereby declared to be delinquent and a penalty of 10% of the delinquent balance shall be added to the trash collection fees due.
(5) Payments received from the sewer customer and/or storm water customer shall be applied first to the trash collection services, second to storm water utility fees and third to sewer utility fees.
(C) The user fees collected in accordance with divisions (A) and (B) of this section are to be deposited in a Trash Collection Fund established in § 34.35, with the revenues retained, accumulated, and used for improvements of the trash collection utility system as permitted by I.C. 36-9-23 and as directed by the Town Council.
