(A) For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ITINERANT. Any person and/or persons who travels from place to place without legal residence within the corporate limits of the town.
PEDDLER. Any person, including a salesperson and vendor, who goes from house to house, place to place, or to any one house or to any one place, or in or along the streets, within the town, selling and making immediate delivery or offering for sale and immediate delivery, any goods, wares, merchandise, newspapers, magazines or services, or anything of value in the possession of the peddler to persons other than manufacturers, wholesalers, jobbers or retailers in those commodities or services.
SOLICITOR. Any person, including a salesperson and vendor, who engages in the business of going from house to house, place to place, or to any one house or to any one place, or in or along the streets, within the town, selling or taking orders for, or offering to sell or take orders for goods, wares, merchandise, newspapers, magazines or services, or other thing of value, for future delivery or for services to be performed in the future, to persons other than manufacturers, wholesalers, jobbers or retailers in those commodities or services.
(B) The terms ITINERANT, PEDDLER, and SOLICITOR do not include and specifically exclude any person or persons engaged in the exercise of free speech as it pertains to religion and/or political conviction as long as such person or persons are only speaking or promoting their cause without the solicitation of funds or sale of material or products.
