(A) Pursuant to I.C. 7.1-5-12-13, the Town Council, as the legislative body of the town, hereby adopts the definition of public building and smoking as set forth in the code, and prohibits throughout all areas of any public building owned by the town, smoking, as defined by I.C. 7.1-5-12-3, and all acts amendatory or supplemental thereto.
(B) Pursuant to I.C. 7.1-5-12-5, the Town Manager, as the agent of the Town Council, shall comply with I.C. 7.1-5-12-5, that requires the conspicuous posting of signs reading “Smoking is prohibited by State Law in all public buildings of the Town of McCordsville, Indiana” and cite as reference therein this section/ordinance.
(C) Any person violating this section, and who fails to refrain from smoking after being requested to do so, may be removed from the public building.
