(A) A water utility owned and operated by the town shall be constructed, acquired or otherwise formed.
(B) The municipally-owned water utility shall operate under the control of the Town Board of Works, which shall consist of the members of the Town Council.
(C) After a preliminary determination of the cost to construct has been determined, this Council will appropriate from the General Fund an amount to pay the preliminary expenses, not to exceed 5% of the estimated cost.
