§ 176.04 PROCEDURE WHEN FOUND GUILTY; PENALTY.
   (A)   When a parent, guardian or custodian is found in violation of this chapter, they shall be guilty of a minor misdemeanor and the person 17 years of age and under who is found in violation of this chapter shall be proceeded against as may be appropriate under this chapter and shall be dealt with in accordance with Juvenile Court Law and Procedures.
   (B)   If the offender has been previously convicted of this offense said offender shall be guilty of a fourth degree misdemeanor and fined not more than $250 and incarcerated for not more than 30 days or both.
