Whenever it shall be deemed necessary by the Council to pave any street, or whenever it shall be necessary to construct any sidewalk on any street, on or along which utility poles have heretofore been erected not in conformity with the provisions of the preceding Section, notice shall be served upon the person in control of such poles to remove and reset the same in accordance with the provisions of the preceding Section, within five (5) days after service of notice. Any and every pole under the control of any person so notified which is not removed or reset within five (5) days shall be deemed a nuisance.
