Any person, firm, partnership, association, corporation, company, or organization of any kind, including any owner, occupant, lessee, or tenant of a premises has the right to purchase from any source a bearproof solid waste container that is the same brand name and model(s) used by the approved solid waste management contractor. The approved solid waste management contractor and the city of McCall shall not be liable for any theft, loss, or any kind of damage that may occur to any bearproof solid waste container that is not leased from the approved solid waste management contractor. Before providing services to a subscriber who has chosen to purchase their own container, the approved solid waste management contractor may, in its discretion, require that subscriber release the contractor in writing from any and all damages to the container that may occur.
