5-3-310: UNLAWFUL PURCHASE OR DELIVERY:

   (A)   It is unlawful for a person, being over the age of eighteen (18) years to:

      1.   Purchase a cigarette, tobacco, or an alcoholic beverage, for delivery to a minor; or

      2.   Sell a cigarette, tobacco, or an alcoholic beverage to a minor.

   (B)   It is prima facie evidence of the intent to violate this section that a person delivers a cigarette, tobacco, or an alcoholic beverage to a minor.

   (C)   Violation of this section is a misdemeanor, and subject to a civil penalty as provided in subsection 5-2-020(C) of this title. A "commercial unit" for such purposes is a pack of cigarettes, a pouch or can of tobacco, a six (6) pack of beer or wine cooler, a bottle or can of other alcoholic beverage, or other like usually individually purchasable amount.
