§ 95.03 SMOKING PROHIBITED IN VILLAGE-OWNED PUBLIC PARKS, BUILDINGS AND FACILITIES.
   (A)   Smoking a nuisance and unlawful.
      (1)   It shall constitute a nuisance and be unlawful for any person to smoke within a building, facility or vehicle owned, leased or otherwise in the possession or under the control of the village.
      (2)   It shall constitute a nuisance and be unlawful for any person to smoke on the premises of any park or other outdoor recreation or outdoor venue owned by the village, including, without limitation, parks, gazebos, pavilions, playgrounds, decks, and patios.
      (3)   However, smoking shall be allowed within the paved vehicular parking areas of any park or other outdoor recreational or other outdoor venue owned by the village.
   (B)   Placement of signage.
      (1)   No-smoking signs shall be conspicuously placed on the inside of all buildings owned, operated, leased and maintained by the village.
      (2)   Signage prohibiting smoking shall also be placed within 15 feet of any playground equipment, and conspicuously at the primary entrance to all parks and outdoor recreational facilities owned by this village.
