§ 51.080 RATES ESTABLISHED.
   (A)   Rates established. There shall be and there hereby are established rates or charges for the use of and for the service supplied by the combined waterworks and sewerage system of the village. All property located within the boundaries of the village, and property located outside the boundaries of the village having a connection with the waterworks and sewerage system of the village, shall pay the current charges for use of and for service supplied by the combined waterworks and sewerage system:
      (1)   There is established a minimum charge of $14.40 per month.
      (2)   All other use and sale of water from any village well, reservoir or hydrant not heretofore set forth in this subchapter shall be at the rate of:
   (B)   Basis for user charges. The charge for the use of and for service supplied by the water and wastewater facilities of the village consists of a debt service charge, a basic user charge for the operation and maintenance of the wastewater facilities plus replacement, and a basic user charge for the operation and maintenance of the waterworks system. The user charge for the wastewater facilities shall be based on water usage as recorded by water meters for normal waste having the following strengths:
      (1)   A five-day, 20ºC biochemical oxygen demand (BOD) of 20 mg/l; and
      (2)   A suspended solids (SS) contents of 250 mg/l.
   (C)   Surcharge. A surcharge will be levied to all users whose waters exceed the normal concentrations of BOD (20 mg/l) and SS (250 mg/l). The surcharge will be based on water usage as recorded by water meters and/or sewage meters for all wastewaters which exceed said concentrations.
   (D)   Annual review. The adequacy of the wastewater service charge shall be reviewed annually by certified public accountants for the village in their annual audit report. The wastewater service charge shall be revised periodically to reflect a change in debt service or a change in operation and maintenance costs including replacement costs.
   (E)   Surcharge rate. The rates of surcharge for wastewaters exceeding the normal concentrations of BOD and SS shall be determined as the need arises.
   (F)   Effective date. The effective date of this section, as amended, is May 1, 1992.
