Whenever any stream or important surface drainage course is located in any area which is being developed or subdivided, the developer or subdivider shall reserve an adequate drainage right-of-way within the site plan or preliminary and final plats as determined by the village and/or the State Department of Transportation, Division of Water Resources, Department of Natural Resources or other applicable governmental entity, along each side of the stream, swale or other drainage structure for the purpose of widening, deepening, sloping, improving or protecting said surface drainage.
