(A) If a person is arrested based upon probable cause to believe that the person has committed any of the offenses enumerated in § 131.06(A) within a prostitution-free zone, the Chief of Police and/or his designees may exclude that person from that prostitution-free zone for a period of 90 days as set forth in § 131.06(A). Every person excluded shall be provided a notice of exclusion and variances substantially similar to Exhibit A attached to Ordinance No. C0-05-09, a copy of which is on file in the Village Clerk's office.
(B) At the time a person is issued a notice of exclusion from a prostitution-free zone, the Chief of Police and/or his designees shall issue a general or any other variances described in § 131.10, following a preliminary review with the excluded person of the need for such variance(s) pursuant to the process described in § 131.10.
(C) The notice of exclusion shall be in writing and a copy delivered to the excluded person. The notice of exclusion shall specify the following:
(1) The area designated as a prostitution-free zone under this chapter, along with a written boundary description and map indicating the area from which that person is excluded; and
(2) Information concerning the right to appeal the exclusion to the Village Manager as provided in § 131.09.
(D) A 90-day notice of exclusion shall automatically convert to a 1-year exclusion upon a finding of guilt or plea of guilty subsequent to arrest for the applicable offense, as set forth in § 131.06(B).
