§ 34.03 NONDISCRIMINATION BY VILLAGE; IN VILLAGE CONTRACTS.
   (A)   Nondiscrimination by Village. The Village shall prohibit all the discriminatory practices set forth in § 34.02 in all departments, divisions, boards, and commissions or the perpetration of any discriminatory practice by any Village officials, their agents or employees acting for or on behalf of the Village.    (B)   Nondiscrimination in Village contracts.
      (1)   The Village and all of its contracting agencies and departments shall include in all contracts negotiated or renegotiated by them a provision obligating the contractor not to commit any of the discriminatory practices set forth in § 34.02 and shall require such contractors to take affirmative steps in the recruitment, hiring, promotion, and upgrading of minority employees. All contracts in excess of $1,000 for purchasing materials, supplies, equipment, services, or for the construction, reconstruction or repair of any Village building facility or public improvement entered into by the Village or any of its boards, divisions, commissions, or departments and authorized by resolution or ordinance shall be an "equal opportunity employer" as defined by 42 U.S.C.A. Ch. 21, § 2000(e) and Federal Executive Orders No. 11246 and No. 11478, which are incorporated herein by reference.
      (2)   All such contracts shall provide:
         (a)   That the contractor and his subcontractor shall submit with their bids a completed contractor employment practices form as provided by the Commission on Community Relations. The form, as prepared by the Commission on Community Relations, shall include the following:
            1.   A statement by the contractor and his subcontractors agreeing to adhere to the provisions of this chapter;
            2.   A report showing affirmative action in employment, upgrading, promotion, transfer, recruitment and advertising for employees, rates of pay or other forms of compensation, and selection for training, including apprenticeship of minorities and women;
         (b)   That the contractor and his subcontractor shall agree:
            1.   To post in a conspicuous place, both in the office and at the job site, notices summarizing the provisions of this nondiscrimination ordinance;
            2.   To state in all solicitations or advertisements for employees placed by or on behalf of the contractor and subcontractor that all qualified applicants will receive consideration for employment without regard to race, creed, color, sex, religion, national origin, ancestry, age unrelated to ability or physical or mental handicap unrelated to ability;
            3.   To notify each of his subcontractors or labor unions of both the contractors' and subcontractors' commitments under this chapter, that in the event of the contractors' or subcontractors' noncompliance with the nondiscrimination clauses of the contract, the contract may be cancelled, terminated or suspended in whole or in part;
            4.   To allow the Village, through its authorized agency, the Commission on Community Relations, to inspect relevant books and records essential to evaluating and insuring compliance.
