§ 130.53 OBSCENE MATERIAL.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a separate meaning.
      PUBLICATION OR OTHER ARTICLE. Any representation, description or embodiment, including but not limited to:
         (a)   Writings and pictures, whether or not printed;
         (b)   Photographs and photographic film, developed or undeveloped;
         (c)   Phonograph records and other sound recordings; and
         (d)   Sculptures.
      OBSCENE. If, considered as a whole, its predominant appeal is to prurient interest; that is, a shameful or morbid interest in nudity, sex or excretion, and if it goes substantially beyond customary limits of candor in description or representation of such matters.
      SALE OR EXHIBITION. Includes circulation, distribution, giving away and all other forms of dissemination.
   (B)   The sale or exhibition of any publication or other article, obscene as judged with reference to ordinary adults, is declared to be a public nuisance, and is prohibited.
   (C)   The sale or exhibition to any person under the age of 18 years of any publication or other article, obscene as judged with reference to ordinary persons of the age of the person to whom the sale or exhibition is made, is declared to be a public nuisance, and is prohibited.
   (D)   No person shall with knowledge of the nature or contents thereof sell, offer to sell, exhibit, or offer to exhibit to any other person any publication or other article which is obscene as judged with reference to ordinary adults.
   (E)   No person shall with knowledge of the nature or contents thereof sell, offer to sell, exhibit or offer to exhibit to any other person under the age of 18 years any publication or other article which is obscene as judged with reference to ordinary persons of the age of the person to whom such publication or other article is sold, offered for sale, exhibited, or offered for exhibition.
