(A) All betting, wagering, speculating, pool-selling, or bookmaking upon any horse race or other races, or the result thereof, and all gambling and every game of chance of any nature whatsoever within the Village is prohibited.
(B) No person shall engage either directly or indirectly in the business of delivering wagers or bets. No person shall as a business accept anything of value to be wagered or to be transmitted or delivered for wager to any race track or race course. It is unlawful for any person to be the owner, lessee, or occupant of any premises, and to knowingly permit the same to be used or occupied for the business of delivering wagers or bets. As used herein
PERSON shall mean and include any individual, partnership, association, joint stock association or trust, corporation, or other business entity, whether incorporated or not.
(C) The maintenance of any such premises as described in division (B) of this section is declared to be a public nuisance.
(D) It is unlawful for any premises within the Village to exhibit or display signs, notices, murals, painted illustrations or other items of advertisement or displays signifying that the premises are used or occupied for the business of delivering wagers or bets. Any such existing signs or displays are hereby ordered removed forthwith.
(E) (1) Any person violating the provisions of this section shall be punished by a fine of not less than $25 and not more than $500 for the first offense.
(2) Offenses in excess of one shall be punishable as a misdemeanor by imprisonment not exceeding 6 months, or by fine, or by both fine and imprisonment.
(3) The aforementioned penalties are not exclusive and are not in any way intended to affect the powers of a municipality to abate a public nuisance. Each day that a violation of this section continues shall be considered a separate offense.
(F) The prohibitions set forth in this section shall not apply to the location, maintenance or operation of any device lawfully licensed and operated as authorized by Chapter 125 of this Code and pursuant to the Video Gaming Act, 230 ILCS 40/1 et seq.
