(A) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ACTS OF VANDALISM. Any of the following acts:
(a) Maliciously, recklessly, or knowingly damaging or destroying any property of another person without their consent; or
(b) Maliciously, recklessly, or knowingly by means of fire or explosive device damage, debasing or destroying any property of another person; or
(c) Maliciously, recklessly, or knowingly starting a fire on land of another person without their consent; or
(d) Maliciously, recklessly, or knowingly depositing on the land or in the building of another person, without their consent, any stink bomb, or any offensive smelling compound and thereby interfering with the use and occupancy by another of the land or building; or
(e) Maliciously, recklessly, or knowingly and without authority entering into orobtaining control over any building, house trailer, motor vehicle, aircraft, or water craft or any part thereof of another person without their consent; or
(f) Maliciously, recklessly, or knowingly damage, destroy, or deface the property of another person, including public property, through the use of any aerosol container of paint.
LEGAL GUARDIAN. Includes a foster parent, a person appointed guardian of a person, or given custody of a minor by a Circuit Court of this state, but does not include a person appointed guardian only to the estate of a minor, or appointed guardian, or given custody of a minor under the Illinois Juvenile Court Act.
MINOR. A person who is above the age of 11 years, but not yet 18 years of age.
PARENT. The lawful father and mother of a minor child, whether by birth or adoption.
PROPERTY. Any real estate, including improvements thereon, and tangible personalty.
RESTITUTION. Paying to a person who owns property damaged or destroyed by an act of vandalism an amount equal to the damages incurred as a result of the act of vandalism and shall also include undertaking at the direction of the Police Department Juvenile Officer tasks designed to correct damage resulting from acts of vandalism or other work which will provide a benefit to the Village and its citizens.
(B) Participation in police social worker program. Within 30 days after a minor who has engaged in an act of vandalism is taken into custody by the Police Department, the minor shall be required to begin participation in the Police Social Worker Program.
(C) Restitution required. A minor who has engaged in an act of vandalism is required within 90 days after being taken into custody to provide restitution.
(D) Parents or legal guardians responsible. The parents or legal guardians of a minor who engaged in acts of vandalism are responsible for insuring that the minor participates in the Police Social Worker Program as required by division (B) of this section and provides restitution as required by division (C) of this section.
(E) Penalties. Any minor who engages in an act of vandalism and is found liable upon entry of an administrative or judicial finding that an offense of vandalism has occurred shall be subject to a fine of not less than $100 and not more than $750 for each offense. Any minor who engages in an act of vandalism and who fails to participate in the Police Social Worker Program as required by division (B) of this section shall be subject to a fine of not more than $500. Any minor who engages in an act of vandalism and who fails to provide restitution as required by division (C) of this section shall be subject to a fine of not more than $500. The parent or legal guardian of a minor shall be subject to a fine of not more than $500 if the minor engaged in an act of vandalism fails to participate in the Police Social Worker Program as required by division (B) of this section and fails to provide restitution as required by division (C) of this section.
