§ 118.04 TAXICAB DRIVERS.
   (A)   Permit required. No person shall drive a taxicab unless the person has been issued a Village taxicab driver permit.
   (B)   Permit fee. The fee for the issuance of a Village taxicab driver permit shall be $25 per year.
   (C)   Requirements for taxicab drivers. All applicants for Village taxicab driver permits shall meet each of the following requirements:
      (1)   Must be not less than 18 years of age;
      (2)   Must have good eyesight;
      (3)   Must not be subject to any infirmity of body or mind which would render the applicant unfit to operate a taxicab in a safe manner;
      (4)   Must be able to read, write and speak the English language;
      (5)   Must be clean in dress and person and not be addicted to the use of narcotics or intoxicating liquor;
      (6)   Must have been issued a valid Illinois driver’s license of the class required to operate a taxicab;
      (7)   Must not have been convicted of reckless driving, driving while intoxicated or manslaughter or reckless homicide resulting from the operation of a motor vehicle within 3 years of the date of application;
      (8)   Must not have been convicted within 10 years of the date of application of either murder, rape, deviate sexual conduct or assault, indecent liberties with a child, contributing to the sexual delinquency of a child, indecent solicitation, public indecency, aggravated incest, prostitution, soliciting for a prostitute, pandering, keeping a place of prostitution, pimping, obscenity, handling of harmful materials, burglary, theft, assault or battery, possession, sale or exchange of instruments adapted for illegal drug use or abuse, possession of a deadly weapon, armed violence, illegal manufacture, possession, sale or delivery of controlled substances or kidnaping.
   (D)   Photographs and fingerprints required. Every applicant for a taxicab driver permit shall file with their application 2 recent photographs of himself, of a size which may be easily attached to their permit, one of which shall be attached to the permit when issued, and the other of which shall be filed with the application by the Building and Code Enforcement Department. Each applicant for a taxicab driver’s permit shall be fingerprinted.
   (E)   Display of permit. All taxicab driver permits shall be numbered when issued and shall contain the permittee’s photograph. Whenever the permittee is driving a taxicab, the permit shall be displayed in a prominent place in the taxicab in a manner that will make it clearly visible to passengers. No person shall deface a taxicab driver permit, nor shall any person remove or obliterate any official entry made on a taxicab driver permit.
   (F)   Change of address or telephone number. Each person to whom a taxicab driver permit is issued shall notify the Building Director of any change that may have occurred in their address or telephone number not less than 10 days after the date the change occurred.
   (G)   Operation of taxicabs.
      (1)   No taxicab driver shall be on duty for more than 12 hours in any 24 hour period.
      (2)   Each taxicab driver shall remain in their taxicab while the taxicab is parked or standing unless the driver is required to get out of the taxicab in order to assist passengers into or out of the taxicab.
      (3)   Every taxicab stopped or parked for the purpose of picking up or discharging passengers shall be stopped or parked with its right wheels parallel to and within 12 inches of the street curb. No taxicab driver shall permit any person to board or alight from any taxicab on any side other than the right side of the taxicab.
      (4)   No taxicab driver shall solicit persons to become passengers in a manner which causes alarm, disturbs another or provokes a breach of the peace. No taxicab driver shall solicit persons to become passengers in a manner which obstructs the movement of persons or vehicles. No taxicab driver shall follow a person for the purpose of soliciting the person to become a passenger. No taxicab driver shall interfere with the proper and orderly access to or egress from any hall, hotel, railway station or other place of public gathering.
      (5)   Every taxicab driver shall have the right to demand payment of the legal fare in advance and may refuse employment unless so prepaid, but no taxicab driver shall otherwise refuse to convey any orderly person upon request anywhere in the Village, unless previously engaged.
      (6)   If requested by the passenger, a taxicab driver shall deliver to the person paying the fare at the time of payment a receipt in legible type or writing containing the name of the taxicab company by or on whose behalf the taxicab is being operated, the Village taxicab vehicle license number of the taxicab, the taxicab driver's Village permit number, the number of the taximeter, any items for which the charge is made, the total amount of fare paid and the date of payment.
      (7)   A taxicab driver shall not charge or attempt to charge a passenger a greater fare than that to which such driver is entitled under the provisions of this chapter.
