§ 31.22 JOINT EMERGENCY TELEPHONE SYSTEM BOARD.
   (A)   Establishment; membership; authority and duties.
      (1)   Establishment. Pursuant to Resolution No. 2017-67 (adopted on December 19, 2017), the Village approved an intergovernmental agreement entitled "Intergovernmental Agreement Establishing The IKE Joint Emergency Telephone System Board And Providing For The Consolidation Of And Operation Of Certain Public Safety Answering Points And The 'Eisenhower Emergency Communication Center' ("IKE 911 Center") (Participating Members: Village Of Broadview And The Village Of Maywood)" (the "Intergovernmental Agreement") that provided for the establishment of an intergovernmental cooperative venture known as the "Eisenhower Emergency Communication Center" (also referred to as the "IKE 911 Center") for the operation and maintenance of a centralized, combined emergency services dispatch and communication system that includes 9-1-1 services and wireless E-9-1-1 services (the "System"). The intergovernmental agreement also provided for the creation of the IKE Joint Emergency Telephone System Board.
      (2)   Membership; authority and duties. The members of IKE Joint Emergency Telephone System Board shall be comprised of the appointed public safety employees from the participating members (e.g., Fire Chiefs and Police Chiefs) plus an appointed public member and an appointed PSAP representative. The authority and duties of the IKE Joint Emergency Telephone System Board shall be governed by the applicable provisions of the intergovernmental agreement and the Emergency Telephone System Act (50 ILCS 750/1 et seq.) and any other applicable laws.
   (B)   Dissolution of local ETSB; re-instatement.
      (1)   Dissolution of local ETSB. Pursuant to Ordinance No. 2017-47 (adopted December 23, 2017), the Village's ETSB was dissolved effective upon the date of the regulatory approval of the IKE 911 Center and the IKE JETSB by the 9-1-1 Administrator of the Illinois Department of State Police.
      (2)   Re-instatement of local ETSB. In the event the Village withdraws from participation in the IKE 911 Center, to the extent permitted by applicable laws and regulations, the Village will either take the necessary corporate actions to re-instate its local ESTB or join another joint emergency telephone system board.
   (C)   Use of ETSB funds; surcharge funds.
      (1)   Use of ETSB funds. Under the Intergovernmental Agreement, the Village, in its own discretion, may use or expend any of its ETSB funds, including any surcharge funds, to pay for budgeted items or obligations that exist in its current 2017/2018 ETSB budget in accordance with the applicable laws, including the Emergency Telephone System Act (50 ILCS 750/1 et seq.), the Wireless Emergency Telephone Safety Act (50 ILCS 751/1 et seq.) and the Prepaid Wireless 9-1-1 Surcharge Act (50 ILCS 753/1 et seq.).
      (2)   Surcharge funds. Upon dissolution of the Village's ETSB and subject to the terms of the intergovernmental agreement and the Village's continued participation in the IKE JETSB, all monies received or collected by the Village that are intended to be used to pay for the operation and maintenance of the IKE 911 Center and its system from any surcharge or revenue source authorized by any federal or State law, including Section 15.3 of the Emergency Telephone System Act (50 ILCS 750/15.3), the Wireless Emergency Telephone Safety Act (50 ILCS 751/1 et seq.) and the Prepaid Wireless 9-1-1 Surcharge Act (50 ILCS 753/1 et seq.), shall be transferred to the IKE JETSB for deposit and expenditure by the IKE JETSB in accordance with the Intergovernmental Agreement and applicable federal or State law.
