§ 110.16 INSPECTIONS.
   (A)   Whenever it is necessary to inspect premises or to analyze a commodity or material in order to determine whether there is compliance with the requirements of this chapter or any other applicable Code, ordinance, rule or regulations, such inspection or analysis shall, unless otherwise specified in the Code, ordinance, rule or regulation, be made by or at the direction of the Building Director. The Building Director shall not inspect any premises or take control of any commodity or material for purposes of analysis unless either:
      (1)   The person in control of the premises to be inspected or in control of the commodity or material to be analyzed voluntarily agrees to permit the inspection or to have the commodity or material analyzed; or
      (2)   A warrant has been issued by a court which authorizes the inspection of the premises or the seizing of the commodity or material to be analyzed.
   (B)   If a person in control of premises refuses to permit the premises to be inspected or if a person in control of a commodity or a material refuses to permit the commodity or material to be analyzed, the Building Director shall apply for the issuance of a warrant which will authorize the inspection of the premises or the seizing of the material or commodity to be analyzed.
