(A) All private residential swimming pools shall be completely enclosed by a fence or other structure on the same property as the property on which the pool is located. Such fence or other structure shall not be less than 4 feet nor more than 6 feet in height. All openings in such fence or other structure shall be equipped with gates or doors with a self-closing and self-latching device designed to keep and capable of keeping such door or gate securely closed at all times when not in actual use and to prevent small children from opening the door or gate; provided, however, that the door of any dwelling and forming any part of the enclosure herein required need not be so equipped.
(B) Above ground type pools, whether temporary or permanent, which have an above ground fence designed and constructed as an integral part of the pool, which fence encloses the periphery of the pool to a height of 4 feet to 5 feet above the top edge of the pool, shall be deemed to meet the enclosure requirements of this chapter.
