§ 94.22 RESTORATION BOND REQUIRED FOR WORK TO BE PERFORMED ON OR AFFECTING PUBLIC IMPROVEMENTS.
   (A)   Anyone who has entered into a contract with anyone or any entity to conduct any construction, repair or other services or work on or affecting Village property and public improvements, or anyone who is engaged in construction, repair or other services on or affecting Village property and public improvements, including, but not limited to, sewers, sidewalks, public parkways, streets, alleys and other public rights-of-way shall provide an executed restoration bond to the Village Community Development Department. The Building Director shall determine what work constitutes work “on or affecting Village property and public improvements” under this section. The bond shall be for the amount of $10,000, such bond to be executed by a surety company acceptable to the Village Building Director or the Director’s designee. The executed restoration bond shall be submitted to the Community Development Department and approved and executed by the Building Director or the Director’s designee before anyone may commence any construction, repair or other services or work on or affecting Village property and public improvements. The bond shall serve as security for the restoration, maintenance and repair to its original or improved condition of all public property affected by the construction, repair or other work and services performed on or affecting Village property and public improvements. The full face amount of the bond is subject to forfeiture by the Village for a period of 1 year after completion of any such work, if after completion of the work, the responsible party has not restored, maintained or repaired Village property or public improvements to its original condition.
   (B)   Any person violating any provision of this section shall, upon a finding of violation, be subject to a fine of not less than $100 and nor more than $500 per violation per day for each offense.
