In addition to any other penalty imposed by this chapter for the erection, contrivance, creation, continuance or maintenance of a public nuisance, the cost of abating a public nuisance by the Village shall be collected as a debt from the owner, occupant or person causing, permitting or maintaining the nuisance, and if proper notice to abate the nuisance has been given to the owner, such cost shall constitute a lien against the real estate in accordance with the provisions of state law, this chapter, and any other applicable provisions of this Code. The Village may authorize the preparation and filing of liens against title to real estate and memoranda of judgment against individuals and corporate entities as well as the preparation and filing of releases related thereto to preserve its rights to collect fines, penalties and other costs imposed by the Village for violations of state law, this chapter and any other applicable provisions of this Code. Village liens and memoranda of judgment shall be filed with the Office of the Cook County Recorder of Deeds or such other appropriate state, federal or county agency. The owner, occupant or person causing, permitting or maintaining the nuisance or violating state law or any provision of the Code shall be obligated to pay to the Village the amount of any fines, penalties or any lien amounts or memorandum of judgment imposed under this chapter or the Code, and all expenses and costs incurred by the Village with respect to abating a public nuisance, subject to adjustment by the Village Manager, or his or her designee, or the Village Prosecutor. In order to obtain a release of a Village lien or memorandum of judgment, the following additional payments to the Village are required:
(A) $50 for the preparation, handling and filing costs of the Village lien or memoranda of judgment, or the actual costs, if greater; and
(B) $50 for the preparation, handling and filing costs of the release of Village lien or release of memorandum of judgment or the actual costs, if greater.
