§ 74.01 PERMIT FOR LAYING TRACKS IN STREETS.
   (A)   It shall be unlawful for any person to lay any railroad tracks in or upon any of the streets or other public places within the Village without first procuring a permit therefor in writing from the Board of Trustees. Such permit shall be issued in accordance with the terms of the respective ordinances under which the tracks may be authorized to be laid and shall specify in full the terms and conditions under which the same shall be constructed.
   (B)   Such permit shall be issued only upon the petition of the owners of the land representing more than one-half of the frontage of the street, or so much thereof as is sought to be used for railroad purposes, and when the street or part thereof sought to be used shall be more than one mile in extent, no petition of landowners shall be valid unless the same shall be signed by the owners of the land representing more than one-half of the frontage of each mile and of the fraction of a mile, if any, in excess of the whole miles, measuring from the initial point named in such petition, of such street or of the part thereof sought to be used for railroad purposes. For every such permit there shall be paid to the Village the cost of issuing the same and the expense of causing the construction, under the permit, to be inspected by such officer as may be appointed by the Board of Trustees.
